Amigo! Communications Inc. Privacy Policy

ACI is committed to taking all reasonable steps to protect the privacy of our clients, and has created this privacy policy to demonstrate our commitment to protecting your personal information and informing you about how we handle it.

About Amigo! Communications Inc.
ACI (the "Company") is a Project Management and Value Added Reseller. Our mission is to provide products and services of the highest caliber for our customers and clients; to demonstrate our commitment to the communities we serve; and to enhance the value of the our services to our customers and clients by partnering with established businesses to deliver high quality and reliable solutions.  The Site is owned by Amigo! Communications, Inc. (the "Owner").

Information Collected

We gather three types of information: private, communicative, and automatic.

Private to the site:

Definition:
Private information is information that can personally identify you such as your real name, email address, telephone number, or credit card number.

Purpose:
When you register to use any Site service, you will be asked for some general identifying information to enable us to provide you with this and other services. We gather contact information (such as your email address and telephone number) and, if you choose to purchase a subscription, credits or other services, financial information (such as your credit card number and expiry date). Your email and telephone contact information is not visible to other users on our site, but will be utilized by our staff, or our agents to allow us to contact or better provide services to you. By supplying your contact information, you are also consenting to the Site, and our agents contacting you in order to provide details of how you may better utilize the services which you have selected to receive, and to provide information to you regarding other services they can offer. Until such time as you advise the Site differently, the email and telephone contact information (along with public information) will not be shared with other organizations, and thus protecting your interest for such marketing or other purposes.

As such, your provision of email and telephone contact information will NOT provide authorization for the usage and provision of that information (along with other public information): (i) to third parties preventing them to contact you for other marketing or commercial purposes as a result of information shared with ACI; and (ii) for the use of other third party organizations for other marketing or commercial purposes. If you do want us to contact you regarding third party products or services or share sharing your contact or public information with other companies or organizations, you can do so by changing your privacy preferences by sending a note to our customer care area releasing your rights to this privacy statement.

Financial information relating to credit card transactions may be processed by the Site via its third party intermediary/financial institution, or by a professional payment authorization service chosen for convenience, security and reliability. In either case, only the purchase price and the credit card information provided by the customer will be supplied, and such information will be maintained in the database for accounting and billing purposes. However, information from these credit card transactions is not released to other third parties. This information is encrypted via a secure server to ensure that others cannot read it. Once on the secure server your credit card information is sent to a third party intermediary for processing. You will know you are in secure mode when the tiny padlock icon - located at the bottom right of your browser - appears "locked". We will only use this financial information in the course of providing our service to you. Specific financial information we collect is not rented, sold, or shared with any third party without your express consent, except to the third party intermediary that processes your transaction or where required by law.

Communicative:

Definition:
Communicative information is exclusive between the Site and parties involved in some form of communication through the Site. Information such as your internal messaging conversations, instant messages, email messages to our service personnel, submission of answers to surveys, and participation in contests are considered communicative information.

Purpose:
We store your messages for the purpose of our anonymous internal messaging system. Just like email, messages must be stored somewhere in order to deliver them.
We acquire information from our surveys so that we can better understand our members and continually improve our service.

Automatic:

Definition:
Automatic information is information that we collect that is not personally identifiable such as your IP address, site usage and purchase behavior, browser type, browser activity, and browser settings.

Purpose:
We use your IP and/or Mac address to avoid fraudulent registrations, and monitor site usage demographics and dynamics. Information that we may obtain regarding your browser and browser settings may be used to ensure that our site's technical features are available to you.

Sharing of Information
The Site may store demographic information, along with the user's email address, in its user database (i) for the purpose for which the information was originally provided by a user, (ii) to pre-populate information fields in the event a user wishes to sign up for and/or subscribe to services, promotions or offers in the future, (iii) to ensure that a user will not be repeatedly exposed to the same ads, offers and promotions while visiting Site, and (iv) to, in connection with regular communication with a user, include offers, promotions or advertisements historically, or likely to be, of interest to that user. We may also use demographic information to tailor the Site and communications to your interests, and we may share demographic information with advertisers or other third parties on an anonymous and aggregated basis such that individual private information or behavior may not be determined (i.e., without telling the advertisers your identity). Our sharing of demographic information is anonymous (i.e., we do not tell which particular users are members of which demographic groups), subject to the rest of this privacy policy. When you respond to an advertisement and give the advertiser your personal information, then the advertiser may be able to identify you as being a member of that demographic group.

We also may disclose your personal information or financial information to third party agents providing or assisting in our provision of services or products to members, and to our subsidiary and parent companies and businesses, and other affiliated legal entities and businesses with whom we are under common corporate control. Whenever personal information or financial information is disclosed under this paragraph, we may also disclose your demographic information, on a non-anonymous basis. All of our agents, parent, subsidiary and affiliated legal entities and businesses that receive your personal information, financial information, or non-anonymous demographic information from us will agree to comply with the terms of this privacy policy with respect to their use and disclosure of such information.

Business Transactions
In the event the Owner sells the Site, or goes through a business transition, such as a merger, being acquired by another company, selling all or a portion of its assets, or enters bankruptcy, members' personal information will, in most instances, be part of the operations or assets transferred. You agree that we or our successors may do so without your further express consent, and you agree that the successor may continue to possess and use the information conveyed in accordance with the terms of this policy. If as a result of the business transition, the members' personally identifiable information will be used in a manner different from that stated at the time of collection members will be given choice consistent with our "Changes to our Privacy Policy" section below.

Changing/Suspending/Removing your Information
The Site may share contact and demographic information with its advertising and marketing partners unless you have elected not to receive third-party offers and promotions. The Site makes an effort to provide you with ads and offers that you may find of interest and of some value. Nevertheless, it is the Site’s policy to allow you to make the choices about, and to control, the information the Site collects and the manner in which that information is used. For this reason, you always have the ability to update, change or delete information collected by the Site, to unsubscribe from any internal or third party mailing or telephone contact list at any time, and to opt out of receiving third-party ads, promotions and offers from the Site directly, and to opt out of further disclosure by the Site of contact information to third-parties for such purposes.

Security
The Owner reserves the right, but has no obligation, to monitor all services used on the Site. This includes but is not limited to the materials posted in the public areas as well as the contents of communications transmitted while engaging in chat, email, or other means of communication. We limit the access to your personal information to employees who we believe need to come into contact with that information to provide services to you or to do their jobs.

The Owner shall have the right to remove any material that violates, or is alleged to violate, the law or our terms of usage. Information may be released when we believe, in good faith, that such release is reasonably necessary to: (1) comply with applicable law or to assist governmental or legal requests; (2) operate the service properly or enforce or apply the terms of any of our user terms, conditions and agreements; or (3) protect the rights, property or safety of our users and/or any third parties.

We have several different safeguards to protect your information, which include physical, technical (such as firewalls and industry-standard SSL encryption to protect data transmissions), and procedural methods. All of these comply with federal regulations and responsible business practices.

Cookies
The Owner may use cookies on our Site. Third party advertisers on the Site may also place or read cookies on your browser. A cookie is a small piece of data that is sent to your browser from the site you are visiting and stored on your computer's hard drive. Cookies are very common and completely normal throughout the Internet. Cookies do not harm your computer nor can they access information stored on your computer. The primary purpose of cookies is to maintain your customized settings on a site. Members that do not accept cookies will not be able to properly use all features of the site.

Third Party Cookies/Tracking: The Site may elect to engage third parties to track and analyze non-personally identifiable usage and volume statistical information from visitors to the Site to help us administer the Site and in order to constantly improve Site quality. Such third parties use cookies or other means to help track visitor behavior and sets cookies on behalf of the Site. Cookies for such purposes do not relate website visitors to any personally identifiable information, and provide the Site with information about site usage that reflects individual behavior of visitors but not their identity. All data collected by on behalf of the Site is used only to provide information on Site usage and is not shared with any other third parties, except as permitted herein.

Single-Pixel Gifs
The Owner and its advertisers may use single-pixel gifs (also known as web bugs, web beacons, or tracking pixels) on the Site. The purpose of these single-pixel gifs is to verify and count web page accesses and gather some statistical information. These single-pixel gifs gather usage and demographic information, but do not gather any personal information.

Email
To enhance your experience as a Site member, we send out message notifications, newsletters and site announcements, and from time to time offers that we feel may have something that will benefit you. Our site provides you with the opportunity to opt-out of receiving different types of communications (except system communications, or communications required for account maintenance), and each email that we send out has a method for opting-out located at the bottom of the message.

Opt-Out and CAN-SPAM Act
You may choose to provide our Site with your email address, personal information, or any other information for the purposes of opting-out of receiving email solicitations in respect of the Site. By this policy and at the point of collection, you agree that we may use and disclose that information for this purpose, in such manner as we deem appropriate. Such use and disclosure shall be carried out in order to allow compliance with our internal and Site policies, and to take all steps we deem necessary in order to ensure compliance with the CAN-SPAM Act of 2003. As such, and without limiting the foregoing, email addresses or any other information you provide may be compiled into a suppression list or other database, and may be provided to third party publishers, advertisers or otherwise for the purposes “scrubbing” their own lists to ensure such third parties do not provide email solicitations in respect of the Site to opted out persons. However, the Site shall not be responsible for the consequences of any release, use or abuse of the information which has been provided to the third party in furtherance of the effecting the opt-out requests, whether such release, use or abuse by that third party was is in breach of any confidentiality agreements or otherwise.

Links
The Owner may have links to other websites on our Site. Some of these other websites contain our brand names and trademarks and other intellectual property that we own; others do not. When you click on these links and visit these other websites, regardless of whether or not they contain our brand names, trademarks and other intellectual property, you need to be aware that we do not control these other websites or these other websites' business practices, and that this privacy policy does not apply to these other websites. Consequently, the operators of these other websites may collect different kinds of information about you, and may use and disclose that information in different ways than we would if it were collected on the Site. We encourage you to review their privacy policies and remind you that we will not be responsible for their actions. However, we are not responsible for the content, privacy practices nor the collection, usage and distribution of private information by third party sites.

In some cases, we may enter into a promotional relationship with another company in which we prominently display their brand name or trademarks on pages of the Site. These pages are known as "Co-Branded Pages" and these companies are known as "Co-Branded Companies." If the page on which you submit information is a Co-Branded Page, or was accessed by clicking on a link on a Co-Branded Page, then we may share your personal information with the associated Co-Branded Company. Co-Branded Companies may use your personal information in accordance with their own privacy policies. You will need to contact Co-Branded Companies to instruct them directly regarding your preferences for the use of your personal information by them. Additionally, you agree that we may use and disclose all such information so submitted to such Co-Branded Companies in the same manner in which we are entitled to use and disclose any other information you submit to us. Some Co-Branded Pages may use cookies (see above) or may contain an action tag (also known as a beacon or a 1 pixel .gif file) that a third party may use to read cookies that it, or its clients, may have placed on your browser at other web sites before your visit to the Site. Further, such third parties may use the information collected through this technology to learn more about your visits to this Site and other websites in order to provide advertisements about goods and services of interest to you. When we disclose your financial information or personal information to a Co-Branded Company, as described above, we may also disclose to that Co-Branded Company your demographic information, other than the content of one-on-one communications between you and other members.

By purchasing, or registering or making reservations for, products or services of third parties offered on the Site, or by participating in programs offered on the Site that are administered by third parties and that require you to submit financial information in order to use them, you also consent to our providing your financial information to those third parties. Additionally, if the page on which you submit information is a Co-Branded Page, or was accessed by clicking on a link on a Co-Branded Page, then we may share your financial information with the associated Co-Branded Company. Any of these various third parties may be authorized to use your financial information in accordance with our contractual arrangements with such third parties and in accordance with their own privacy policies, over which we have no control, and you agree that we are not responsible or liable for any of their actions or omissions. Additionally, you agree that we may use and disclose all such information so submitted to such third parties in the same manner in which we are entitled to use and disclose any other information that you submit to us.

Any third party with whom we are allowed to share your personal information is authorized to use your personal information in accordance with our contractual arrangements with such third parties and in accordance with their own privacy policies, over which we have no control, and you agree that we are not responsible or liable for any of their actions or omissions. Those who contact you will need to be instructed directly by you regarding your preferences for the use of your personal information by them.

Associates
When you register to become an associate of our site, you will be asked for contact information and information related to your site. Except as permitted herein, it will not be shared with any third party without your explicit consent except in situations where required by law. Your information will be used to secure your approval as an associate, to facilitate communication between our two sites and to send you payment, based on your site's performance.

Changes to our Privacy Policy
From time to time, we may use information for new, unanticipated uses not previously disclosed in our privacy policy. As such, please review this privacy policy periodically as we may modify it from time to time. If our information practices change at some time in the future, we will notify all registered members of any change to this privacy policy either by posting a notification on the site or via email, unless you have opted-out of receiving email from us, and provide you with the ability to opt out of these new uses. If you are concerned about how your information is used, you should check back at our Site periodically. Continued use of the Services or non-termination of your membership after changes are posted or emailed constitutes your acceptance or deemed acceptance of the terms as modified, regardless of whether the notice or email was successfully received, read, or lost during transmission. Each time you visit the Site or provide us with information, by doing so you are accepting the practices described in this privacy policy at that time.
